TERMS OF SERVICE

These Terms of Service govern your use of the TOVYNX online store and any purchase you make from us.

By visiting our store, placing an order or using our services, you agree to these Terms of Service. If you do not agree, please do not use the store.

Nothing in these Terms limits or removes any mandatory consumer rights available to you under applicable law.

1. ABOUT TOVYNX

TOVYNX operates this online store and sells products directly to customers.

Our store is hosted by Shopify, which provides the e-commerce platform that allows us to offer products and services to you.

By using this store, you confirm that you are legally capable of entering into a binding contract or that you have permission from a parent or legal guardian.

We make reasonable efforts to display product descriptions, colours, images, compatibility and other details as accurately as possible.

Colours and appearance may vary slightly depending on your screen, lighting and device settings.

You are responsible for selecting the correct phone model, product option, colour and quantity before completing your purchase. Please review all product information carefully before ordering.

4. PRICES AND TAXES

Prices are displayed in the currency shown on the store.

Applicable taxes and delivery charges will be displayed before you complete your order, where required.

We may change prices at any time, but a price change will not affect an order that we have already accepted.

If an obvious pricing or product information error occurs, we may contact you to confirm the correct details or cancel the affected order and provide a full refund.

5. ORDERS

Submitting an order is an offer to purchase products from TOVYNX.

After placing an order, you should receive an order confirmation. We may refuse or cancel an order where reasonably necessary, including if:

• A product is unavailable

• Payment cannot be authorised

• We reasonably suspect fraud or unauthorised activity

• Delivery information is incomplete or invalid

• There is an obvious pricing or product information error

• The order breaches these Terms or applicable law

If we cancel an order after payment has been taken, we will refund the amount paid using the original payment method.

6. PAYMENT

Payment must be completed using one of the payment methods available at checkout.

Payments are processed by Shopify and relevant third-party payment providers. By providing payment information, you confirm that you are authorised to use the selected payment method.

We do not directly store your complete payment card information.

7. SHIPPING AND DELIVERY

Available delivery options, estimated delivery times and delivery charges will be displayed in our store or during checkout.

Delivery times are estimates unless we expressly agree otherwise. Delays may occasionally occur because of customs, carriers, weather, high order volumes or circumstances outside our reasonable control.

We will provide updates where reasonably possible if we become aware of a significant delay.

You are responsible for providing a complete and accurate delivery address. If an address is incorrect or incomplete, delivery may be delayed or the parcel may be returned.

8. RISK AND OWNERSHIP

Responsibility for the product passes to you when it is delivered to you or to a person identified by you to receive it.

Ownership passes to you after we have received full payment for the product.

9. CANCELLATIONS, RETURNS AND REFUNDS

Eligible customers generally have the right to cancel an online purchase within 14 days of receiving the product.

Nothing in these Terms limits your legal rights concerning faulty, damaged, incorrect or misdescribed products.

10. DAMAGED, FAULTY OR INCORRECT PRODUCTS

If a product arrives damaged, is faulty, is not as described or is not the product you ordered, contact us as soon as possible through our Contact Us page.

Depending on the circumstances and your legal rights, an appropriate solution may include a repair, replacement, price reduction or refund.

TOVYNX will cover reasonable return costs where required by law for a faulty, damaged, incorrect or misdescribed product.

11. ACCOUNTS

If you create an account, you are responsible for keeping your login information confidential and for activities carried out through your account.

You must notify us if you believe your account has been accessed without permission.

We may suspend or close an account if we reasonably believe it is being used fraudulently, unlawfully or in breach of these Terms.

12. ACCEPTABLE USE

You must not use our store:

• To violate another person’s rights

• To submit false or misleading information

• To distribute viruses, malware or harmful code

Unless stated otherwise:

• Discount codes cannot be exchanged for cash

• Only one discount code may be used per order

• Discounts cannot be applied after an order has been completed

• Promotions are subject to availability

We may withdraw or correct a promotion where there is an error, fraud or misuse, without affecting orders already lawfully accepted.

17. AVAILABILITY OF THE STORE

We aim to keep our store available and secure, but we do not guarantee uninterrupted access.

By using the store, you acknowledge that Shopify and relevant service providers may process information necessary to operate the store, process payments, fulfil orders and provide services.

The latest version will be posted on this page with an updated revision date. Changes will not unfairly alter the terms applicable to an order already accepted.

21. SEVERABILITY

If any part of these Terms is found to be invalid or unenforceable, the remaining sections will continue to apply.

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

23. GOVERNING LAW

These Terms are governed by the laws of Ireland.

If you are a consumer living elsewhere, you retain any mandatory protections provided by the laws of your country of residence. Nothing in these Terms prevents you from bringing a claim in a court available to you under applicable consumer law.
